CORRECTIVE NOTICE
Australian Opal Cutters Pty Ltd (ACN 092 602 027) (AOC) would like to advise its valued customers that the Australian Competition and Consumer Commission (the ACCC) has raised concerns that certain representations made by AOC are likely to be false or misleading or deceptive and therefore are likely to contravene the Trade Practices Act 1974 (the Act). These representations are composed of: -
implied representations made by AOC, between the approximate dates of September 2007 and February 2009 that AOC's advertising practices had been "cleared", "checked out" or otherwise approved by the ACCC in an investigation conducted by the ACCC in December 2005; -
representations made by AOC, since at least December 2005 and until approximately March 2009, that its prices were "50-55% off normal retail prices" or "40-60% off normal retail prices".
AOC admits that it made these representations and that, in making them, it is likely to have contravened the prohibitions on misleading, deceptive and false conduct in the Act. AOC has offered several undertakings to the ACCC in respect of the above representations and conduct and these undertakings have been accepted by the ACCC. These undertakings include:
o an undertaking that AOC will not advise its customers that AOC has been "cleared", "previously cleared" or "checked out" by the ACCC; and
o an undertaking that AOC will no longer refer to "normal retail prices" in its advertising or in any invoices provided by AOC to its customers.
o an undertaking by AOC to implement a trade practices compliance program (Compliance Program) which will minimise the risk that AOC will contravene the Act in future;
AOC apologises to its customers for any detriment which AOC has caused in relation to the representations described in this notice. About Us
We have an international reputation for providing exceptional opals and pearls at very affordable prices. You may be wondering how we can provide such high calibre stock at such low prices. We buy bulk, cut and polish from rough gem material, make our own settings, have our own workshop and our workshop/office is not a shop front, therefore our overheads are a fraction of the cost of running a shop front retail store.
We also have long-standing, loyal relationships with our suppliers and accordingly, this translates into savings for our valued clients. Although we appreciate that most customers are jewellery ‘savvy’, we offer a unique free service to every customer that walks through our door by briefing them on the different qualities, characteristics and what to ‘look out for’ when purchasing opals and pearls.
